The Real Estate Commission is currently in the process of establishing regulations that will dictate the requirements of the Recovery Fund. However, our statutes regarding the Recovery Fund have been effective since March 1, 2010. The statutes provide for a general overview of the Recovery Fund process. The Real Estate Surety Fund was established to reimburse consumers for financial loss in a real estate transaction because of a licensee’s fraud, deceit, intentional misrepresentation or conversion of trust funds.
